Man still drunk from night before jailed for hitting cyclist

A male driver who drank one evening and collided with a bicycle the next morning on his way to work was sentenced to one month administrative detention with a fine of 1,000 yuan (US$147) by the Hongkou District People’s Court, prosecutors in Hongkou District said.

According to the Hongkou District People’s Procuratorate, last year it handled 115 cases related to dangerous driving, with this being a typical case of “overnight” drunk driving, a situation often neglected by drivers.

Prosecutors said the driver, surnamedQian, drank with his friends on November 19 last year. Knowing he couldn’t drive after drinking, he hailed a taxi home and had a sleep. At 5am the next morning he drove to his office but crashed into a bicycles on the way. When traffic police officers arrived, they suspected Qian of driving after drinking and took him to the hospital for a check.

A blood-alcohol test showed the alcohol content in his blood was 115.5 milligrams per 100 milliliter, 35.5 milligrams higher than the limit of 80 milligrams per 100 milliliter.

Qian was then arrested and charged by Hongkou prosecutors of dangerous driving, which brought him one month under detention and a fine.

Prosecutors warn drivers that people’s alcohol metabolism depends on their own health condition.

In another case that happened one month earlier than Qian’s, a motorcyclist, surnamed Huang, crashed into a car parked on Dongtiyuhui Road with his unlicensed motorcycle.

After being taken to hospital, the alcohol content in his blood was found to be 189.45 milligrams per 100 milliliters. He was given three months' detention and fined 3,000 yuan.

Some riders of light motorbikes often think they won’t be punished for driving after drinking, prosecutors said. But under the law, some two-wheel and three-wheel vehicles are also included.
