A man who made and sold counterfeit Kiwi shoe polish products has been ordered to pay compensation of 3 million yuan (US$447,300) to American manufacturer S. C. Johnson & Son, the Pudong New Area People’s Court ruled yesterday.

The man, surnamed Wang, was earlier sentenced by the Ningdu County People’s Court in Jiangxi Province to three years in jail, with a four-year reprieve, and fined 50,000 yuan for counterfeiting a registered trademark in December 2017.

According to the Pudong court, S. C. Johnson & Son said Wang began producing and selling fake Kiwi shoe polish in August 2014.

Wang was arrested by police in October 2016 after a complaint from the company.

Storage registration records showed that the value of products he sold in nine months was more than 7 million yuan.

The company later took Wang to the Pudong court, demanding 300 million yuan in compensation. It believed, based on the records, that Wang’s annual sales reached 10 million yuan.

However, Wang said the records were for attracting customers and not accurate. He said the true figure was 1.1 million yuan.

But the court still took them into consideration as they had Wang’s signatures, and could be correlated with other evidence.
