The Social Assistance Principle of "Helping the Weak" Reflects Equity and Justice

As indicated by Hu Yuhong in the fifth issue 2022 of the Jurist,“helping the weak” is the very principle of ensuring people’s livelihoods, first raised by President Xi Jinping in the report of the 19thNational Congress of the Communist Party of China, reflecting the importance that the Xi Jinping Thought on the Rule of Law attaches to the weak. The analysis on “the weak” can be made from the aspects of physiology, opportunities, abilities and circumstances. The reason why “helping the weak” could become the basic principle to guide the construction of the rule of law for ensuring people’s livelihoods in the new era is that it reflects the fundamental purpose of our legal system which is to protect people's subsistence and livelihoods, and demonstrates the values of social equity and justice; and it also constitutes a basic principle of eliminating negative impacts of unfavorable natural and social factors. The right to subsistence, the right to work and the right to education are the three most basic rights for the social assistance of helping the weak.
